These terms govern your use of myDxHub: the patient portal, the practice tools, and the online store. By creating an account or using the platform, you agree to them.
1. What myDxHub is
myDxHub is a platform that connects practices, diagnostic laboratories, and patients. Practices order diagnostic tests, laboratories return results, and patients view their own records through a secure portal. The store allows the purchase of diagnostic test kits.
2. Not medical advice
myDxHub displays and organizes diagnostic information; it does not practice dentistry or medicine. Content on the platform, including scores, summaries, and educational material, is for informational purposes only and is not a substitute for professional judgment. Always consult your healthcare provider about your results and treatment.
If you have a medical emergency, call your local emergency number immediately. Do not rely on the platform for urgent communication with your care team.
3. Accounts
You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for activity under your account. Patient accounts are connected to a practice; practice and provider accounts must be created by people authorized to act for that practice.
We may suspend or terminate accounts that violate these terms, compromise platform security, or misuse other people's information.
4. Health information
Health information on the platform is governed by our Privacy Policy and, where applicable, HIPAA and our business associate agreements with practices. Patients control third-party sharing of their records through the tools in their portal.
5. Store purchases
- Prices are shown at checkout and charged in US dollars. Payment is processed by Stripe; we do not store your full card details.
- Diagnostic test kits are for use as directed. Laboratory processing of a kit is subject to the laboratory's own requirements, including sample quality.
- For questions about an order, or to ask about returns or refunds, contact support@mydxhub.com. Because test kits are health products, they may not be returnable once opened.
6. Acceptable use
You agree not to:
- Access records you are not authorized to access, or attempt to circumvent access controls.
- Use the platform to violate any law, including healthcare privacy laws.
- Probe, scan, disrupt, or overload the platform, or introduce malicious code.
- Misrepresent your identity or your authority to act for a practice or patient.
- Resell or scrape platform content or data.
7. Intellectual property
The platform, its software, design, and content (other than your records and your practice's materials) belong to myDxHub and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the platform as intended. Your health records remain yours.
8. Disclaimers
The platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted or error-free, or that results will be available by any particular time.
9. Limitation of liability
To the fullest extent permitted by law, myDxHub will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the platform. Our total liability for any claim will not exceed the greater of one hundred US dollars or the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
10. Termination
You may stop using the platform at any time and may request account closure via support@mydxhub.com. Provisions that by their nature should survive termination, including health-record retention obligations, disclaimers, and liability limits, survive.
11. Changes to these terms
We may update these terms as the platform evolves. If changes are material, we will notify you through the platform or by email before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Georgia, unless applicable law requires otherwise.
